Broker Co-op Policy


At Capitol Homes Inc., we take every step necessary to honor the letter and spirit of the law as outlined in the Official Manual of Tennessee Real Estate Commission section 62-13-604. This section clearly states that it is unlawful to interfere with any agency relationships. As a result, the following is our policy regarding real estate commissions to other real estate brokers.
1. We will always honor any broker that accompanies and registers a customer on their initial visit. To register a customer, a broker must fill out or allow a customer to fill out a Capitol Homes registration card and have their name and contact information clearly indicated on the card.
2. Buyer’s agents will be honored if they can produce a copy of a signed Buyer’s Agent agreement, as specified in the Official Manual of Tennessee Real Estate Commission section 62-13-401, which predates a contract between a Purchaser and Capitol Homes, Inc.
3.  The compensation for all  Homes shall be two and a half (2.5%) of the Total Sales Price as listed on the Alta at closing unless otherwise negotiated.

In the absence of these 2 conditions, any attempt by a real estate broker to receive a commission from Capitol Homes Inc. not stated in our contract with the customer will be construed as an attempt to interfere with the agency relationship we have established with the customer that they have agreed to in writing.
